The Senate voted Feb. 28 on the "Women's Health Protection Act." This legislation would supersede all state laws that regulate or restrict access to abortions legally. The Senate voted to reject the bill by a vote of 46-48.

This bill, known as the Women's Health Protection Act, was proposed in June 2021.

“The decision by Senator Schumer to hold a vote this week on the so-called ‘Women’s Health Protection Act’ is further proof that Democrats are afraid to tell the American people what they really believe," former White House Chief of Staff Mick Mulvaney said. "This bill is so extreme that he purposely chose to vote on it while Americans are rightfully focused on the war in Ukraine. Senator Schumer has often said that time is the most valuable commodity in the Senate. That he is choosing to spend that time on this bill, which is opposed by an overwhelming majority of Americans, instead of spending it on Ukraine, is yet another indication as to how radical, extremist, and out of touch the Democrat Party is.”

The legislation would have banned "governmental restrictions on the provision of, and access to, abortion services." If it had passed, abortion providers would have had unlimited abilities to prescribe drugs, use "telemedicine" services to perform abortions, and to carry out abortions "immediately." Abortion providers would not have been required to "comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions."

Governments would also not have been able to regulate the time in a woman's pregnancy at which she could have an abortion. Senator Mark Kelly (D-AZ) was a co-sponsor of the bill.

The Dobbs v. Jackson Women's Health Organization Supreme Court case is another key abortion battle going on right now, with a decision expected in a few months. Oral arguments were heard for the case in December.
